You could have a restriction in the tub spout or just too much pressure. Diverter only restricts flow to tub spout so any restrictions to the tub spout will cause water to go up to shower head.
You need to order seals and replace them. Typically, dirt in the water system damages the rubber (neoprene, plastic) soft parts. Sometimes the damage wrecks metal parts, but this is less common.
remove the temp handle first decorative handle then brass sleeve under that brass should slide straight out you will see the mixing housing witch is brass cup shape piece about the size of washing powder cap there will be a small black plastic screen there pull out clean and replace then put back together should have good pressure which will fix diverter problem
Take handle back off and see if it has a dial that can be removed and repostioned. take off and move it about 1/4 turn counter clockwise and reinstalled and try to see if mixture is correct.
Try draining the system and apply air pressure (min 30psi) to each faucet. Open other hot water faucets to allow pressure to vent. Next try draining and cleaning the hot water tank.
