Possibly, duct work, air not balanced, too much load, no insulation, undersized unit, AC not properly charged.
A simple test is to measure the temperature entering the unit and the temperature exiting the unit, at the unit. The temperature difference should be about twenty degrees Fahrenheit. That's a good working unit.
Explain further. You change the setpoint to 71 and the room temp goes up to 75 or the setpoint changes to 75 by itself.

it's possible sometimes you can get brand new junk. one question is the thermo coupler in the right postion? i would check to make sure that it is indeed picking up the temp like it should.

If you still have the instructions for the thermostat, then it will show you how to get into the menu and set the swing on the temps. I would try to explain off the top of my head, but its actually quite a bit off numbers to remember. Hope it helps somehow.

what it sounds like happening is the unit is realizing it is falling behind most thermostat s have a 3 degree deadband if they fall 3 degrees or more at a time after running for so long then it will bring on the emergency heat which is located in your inside unit... when it gets really colds and you see this you need to go outside and look is the outside unit still running and is it freezing up on you...also if running check the larger of two pipes make sure the large pipe is hot to touch...based on the description you have given the thermostat is calling for emergency heat but for some reason is not bringing it on or there is a problem with the emergency heat.... hope this helps out some
