No. The i cloud account belongs to that owner forever. You should do a factory reset and create your own cloud account. Cloud accounts are where personal data is stored.

I don't think a few days ago will cut it. I'm sure if it was your phone you would like for the person that finds it to do everything possible to return it to you.
Either way, there is nothing you can do, and I'll explain:

Most likely the iPhone 5 must be on IOS7 or later, meaning that there is a security patch that nobody will be able to remove anything from the iPhone but the owner.
If you try to reset the phone, at the beginning of the welcome page, it will ask for the owners email and the password. Even if you try to set it as brand new, it will ask for those info.
If the owner was smart enough to enable restriction, with Find My iPhone enable, that's it, there is nothing else you can do. To disable the restrictions you must go to Settings, General, Restriction, and once here, you need a password to disable it, which usually is completely different from the lock screen.
And the only way to disable iCloud or Cloud, is by deleting the owners email address which is in restrictions.

It like any other app, remove from setting app.

If it has ios7 you are stuck if the previous owner used find my iphone. This feature in the latest version will permalock the phone. The only way to fix it is to have the original owner unlock with iCloud. This is a safety feature they added so that if a phone was ever stolen not even a reset could fix it. It is tied to the sn number imbedded in the phone. If they will not remove the feature you have a bricked / useless phone.

I have the same problem. The repair guy said it's the optical engine and you may as well replace the set as pay for the repair. First time I'm glad I bought the extended warranty. That's another story. Zonieal
