Everything works OK including brakes but when brake/clutch pedal fully depressed & the parking brake lever then lifted up, the brake pedal will not stay locked down when I lift my foot.

The brake is on the right side of the transaxle. There are two mounting bolts and one 1/2 nut in the middle that is your adjustment. Tighten it 1/2 turn at a time and hold the brake down and try to roll it until it holds.

I just got the kit 175067. Have the old one off except for where it's attached to the lever, schedule and weather has kept me from going further. Very simple to reconnect things at the pulley and above but not too sure how to connect the rest onto the lever and haven't had a chance to get a good look at how the old one might be connected yet. Should be a simple fix.

This is a shot in the dark. I think you have a failed "operator presence safety switch". Rule this out by finding the switch and jumping it.
Your mower should run with no one in the seat IF THE PARKING BRAKE IS SET.
If the brake is released and no one is on it, it should shut off.
If you are on it and the brake is released you should be able to engage the blades (probably an electric clutch)
Purpose of this interlock is the shut the machine OFF should you fall off or jump off the machine. Do not disable this valuable safety feature.

the seat switch is the problem. the switch itself could be bad, but usually theproblem is that the connector is just not plugged in all the way [by the way, trying to bypass the switch by inserting the wire doesn't work because there is a "switch" inside the connector to prevent you from doing just what you did]
